This website, maniatisfoods.com (the "Site"), is operated by Kala Mata LLC, a Texas limited liability company operating as Maniatis Foods (collectively "Maniatis," "we," "us," or "our"). Our Privacy Policy and Return Policy are incorporated into these Terms. By using this Site you agree to these Terms. Our Site is hosted on Shopify Inc.

1. Online Store Terms

You must be at least the age of majority in your jurisdiction. You may not use our products for any illegal purpose or transmit malicious code.

2. General Conditions

We reserve the right to refuse service to anyone for any reason at any time. Credit-card information is encrypted in transit via TLS/HTTPS.

3. Accuracy, Completeness, Timeliness

We are not responsible if information on this Site is not accurate, complete, or current. The bottle or tin you receive will carry a physical lot number and bottling date on its label; always check the physical product for the most accurate record.

4. Modifications to Service and Prices

Prices are subject to change without notice. We reserve the right to modify or discontinue the service at any time.

5. Products and Services

Certain products are available exclusively online. We cannot guarantee monitor-color accuracy.

Food products. Our products are extra virgin olive oil, olive spreads, and related food items. They are subject to natural variation between harvests. Tasting notes describe our expectations; your experience may differ based on storage, temperature, and palate. We do not make medical claims for our products; statements about Mediterranean-diet research, polyphenol content, or traditional culinary use are educational and are not intended to diagnose, treat, cure, or prevent any disease.

Harvest-year vintages. We press once a year. Vintages, lot numbers, and laboratory specifications published on the Site describe a specific production run and may not match the bottle you receive if inventory turns over between page updates. The lot number and bottling date on your physical bottle are the most accurate record.

Availability. Between harvests, specific SKUs may be sold out. We do not guarantee availability.

6. Accuracy of Billing and Account Information

We reserve the right to refuse any order and to limit quantities. Wholesale inquiries should be directed to wholesale@maniatisfoods.com.

7. Optional Tools

Third-party tools are provided "as is" without warranties.

8. Third-Party Links

We are not responsible for third-party websites linked from our Site.

9. User Comments, Feedback, and Submissions

You agree we may use submitted comments/ideas without restriction. Comments must not violate third-party rights or contain unlawful material.

10. Personal Information

Governed by our Privacy Policy.

11. Errors, Inaccuracies, Omissions

We reserve the right to correct errors and cancel orders as needed.

12. Prohibited Uses

You may not use the Site for unlawful, harmful, or infringing purposes, to harass or discriminate, to transmit malicious code, to collect personal information of others, to spam, or to circumvent security features.

13. Disclaimer of Warranties; Limitation of Liability

Service and products provided "as is" and "as available" without warranties. In no case shall Kala Mata LLC (d/b/a Maniatis Foods) be liable for any direct, indirect, incidental, punitive, special, or consequential damages arising from your use of the service or any products.

14. Indemnification

You agree to indemnify, defend, and hold harmless Maniatis against any claims arising out of your breach of these Terms or any law.

15. Severability

If any provision is unlawful, void, or unenforceable, the remaining provisions remain valid.

16. Termination

These Terms remain effective until terminated by either party. We may terminate access for suspected breach.

17. Entire Agreement

These Terms and our posted policies constitute the entire agreement.

18. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-laws principles. Disputes shall be resolved exclusively in the state or federal courts located in Dallas County, Texas. The UN Convention on CISG is excluded.

19. Dispute Resolution

Before filing formal legal action, please contact hello@maniatisfoods.com to resolve disputes informally. If unresolved within 30 days, either party may pursue formal action per Section 18.

20. Changes to Terms of Service

We reserve the right to update these Terms. Continued use constitutes acceptance.
